8. Construction

Preparation and approval of a detailed development plan

Competent authority

  • The mayor of the municipality if the draft DDP is for a part of a town or  settlement within three districts, and also for properties outside the borders of towns, villages or settlements;
  • The municipal council if the draft DDP is for a part of a town or village or settlement comprising more than three districts;
  • The district governor if the draft DDP comprises more than one municipality;
  • The Minister of Regional Development and Public Works if the draft DDP comprises more than one district, concerns settlements of national importance or envisages the construction of a site of national importance.

Procedure and required documents

1)       Filing an application for assigning the preparation of a DDP and obtaining the competent body's authorization;

2)       Making an assignment containing the requirements to the territorial scope, terms and stages of making. The assignment shall be coordinated with the Ministry of Environment and Water for considering the need for environmental assessment;

3)       Making of a draft DDP;

4)       Publishing the draft in the State Gazette by the municipality;

5)       Acceptance of the DDP by an expert committee of the relevant competent body;

6)       Approval of the draft by the relevant competent body.

Terms

  • Interested persons may submit objections within 14 days from the publication;
  • The acceptance of the DDP by an expert committee shall take place within 1 month from the end of the objection period;
  • The approval shall take place within 14 days/1 month depending on the competent body.

 

Issuance of a design visa

Competent authority

  • The chief architect of the municipality or region

Procedure and required documents

1)       Filing an application for the issue of a design visa;

2)       Documents evidencing the ownership title to the property shall be enclosed; right to construction; limited rights in rem; environmental impact assessment (if necessary depending on the type of the construction), etc., depending on the specifics of the construction.

  • 14 days


Preparation of an investment design

Competent authority

  • Designer;
  • Consultant;
  • Utility companies (power supply, water supply, etc.);
  • Fire-safety authorities.

Procedure and required documents

1)       Conclusion of an agreement for designing and preparation of an investment design by a licensed designer;

2)       Conclusion of an agreement with a consultant for evaluating the design's compliance with the stipulations of the detailed development plan and the development rules and regulations;

3)       Environmental impact assessment if that is required by the Law on Environment Protection;

4)       Conclusion of preliminary agreements with the utility companies for connection to the technical infrastructure networks;

5)       Approval of the fire-safety authorities (for first- and second-category constructions).

Coordination and approval of the investment design

Competent authority

  • The chief architect of the municipality or region;
  • The district governor, regarding technical infrastructure sites of a scope and importance for more than one municipality;
  • The district governor, regarding technical infrastructure sites of a scope and importance for more than one municipality;
  • The Minister of Defense, the Minister of Interior, respectively, regarding special sites connected with the defense and security of the country.

Procedure and required documents

1)       Filing an application to the competent authority for an approval of the investment design;

2)       Documents shall be attached which may vary depending on the category and specifics of the construction, e.g. documents certifying the ownership title to the property; right to construction; limited rights in rem; designing visa; three copies of the investment design; assessment of the compliance of the investment design with the material requirements to construction sites; approval from the fire-safety and emergency authorities; resolution regarding environmental impact assessment in the cases where such assessment is required; preliminary agreements with the utility companies for connection to the technical infrastructure networks, etc.

  • The Minister of Defense, the Minister of Interior, respectively, regarding special sites connected with the defense and security of the country.

2)       Documents shall be attached which may vary depending on the category and specifics of the construction, e.g. documents certifying the ownership title to the property; right to construction; limited rights in rem; designing visa; approved investment design; assessment of the compliance of the investment design with the material requirements to construction sites; approval from the fire-safety and emergency authorities; resolution regarding environmental impact assessment in the cases where such assessment is required; preliminary agreements with the utility companies for connection to the technical infrastructure networks, special authorizations required under special laws, etc.
